Terms and conditions

These terms govern your use of the Crazy Elephant game for iPhone and iPad and this website. By installing or playing Crazy Elephant you agree to them. If you do not agree, please do not use the game.

The short version

  • Crazy Elephant is free to download. Pack 1 is free, and more packs and extra balls are optional in-app purchases.
  • Purchases are handled by Apple. Refunds go through Apple too.
  • Play fair on the leaderboards.
  • The levels you build are yours.
  • The game is provided as is. We do not promise it is free of bugs or that it stays available.

Using the game

You get a personal, non exclusive, non transferable licence to use Crazy Elephant on devices you own or control, for as long as you comply with these terms and the App Store's usage rules. You may not copy, sell, rent, reverse engineer or attempt to extract the source code of the game, except where the law expressly allows it. The game, its name, its icon, its art, its levels and its design remain ours.

In-app purchases

Crazy Elephant offers these in-app purchases through the App Store:

  • Unlock All Packs opens every level pack, now and later. It is a one-time purchase for your Apple Account.
  • Extra balls (1 or 5) give you one more ball in any level. They are used up when you use them, and a used extra ball cannot be returned.

The payment, the receipt and any refund are handled by Apple, not by us. Prices are shown before you confirm. Refunds are granted by Apple under their own policy, so refund requests go to Apple. Unlock All Packs comes back on any device with Restore purchases in the shop. Extra balls you have not used yet sync through your iCloud account; with iCloud turned off, they stay on the device where you bought them. Your statutory consumer rights under Austrian and EU law are not affected by anything in this section.

Fair play

Leaderboards and achievements run on Apple's Game Center and are meant to compare real play. Do not use cheats, modified versions of the game, automation or other tricks to post scores or earn achievements. We may ask Apple to remove scores that were clearly not reached by playing, and Apple's Game Center terms apply to what you post there, including your nickname.

Your own levels

The levels you build in the level editor are yours. They are stored on your device, we do not collect them, and we claim no rights to them. We cannot recover them if you delete the app or lose your device, so keep that in mind before you delete it.

What Crazy Elephant does not promise

Crazy Elephant is provided as is and as available. We do not promise that it is free of bugs, that it runs on every device or iOS version, or that a level, a pack, a purchase or an online feature such as iCloud sync or Game Center will stay available. Apple may change how iCloud, Game Center or the App Store work, and an update can change a feature. We may change levels, par values and balancing in updates.

Your data

Your progress is saved on your device and, if you use iCloud, in your own iCloud account. The privacy notice explains what is and is not collected.

Liability

We are not liable for lost progress, lost levels, lost profits or indirect damage, or for services run by Apple such as iCloud, Game Center and the App Store.

Nothing here limits liability that cannot be limited by law, including under the Austrian Product Liability Act and mandatory consumer protection rules. Where a term of these conditions turns out to be invalid, the rest stays in force.

Changes and governing law

We may update these terms. The current version always lives at this address, with the date at the top, and continuing to play Crazy Elephant after a change means you accept it. Austrian law applies, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer in the EU, you keep the protection of the mandatory rules of the country you live in, and you may bring a claim in your own country's courts.
